Subject: Receipt of information concerning the filing of a class action lawsuit regarding technical solutions used by GOG

Legal basis: Art. 17 item 1 of the Market Abuse Regulation – inside information

The Management Board of CD PROJEKT S.A. with a registered office in Warsaw (the “Company”) hereby announces that on 6 September 2024 it received information that a civil class action lawsuit against the Company (Class Action Complaint) (the “Lawsuit”) had been filed in the United States District Court for the Eastern District of New York. The Lawsuit was filed on behalf of a user and a putative class of users of the GOG.com digital distribution platform for the video games (“GOG”), which is owned by GOG sp. z o.o., a subsidiary of the Company.

The plaintiff requests that the court adjudicates whether the use by GOG of certain technical solutions complies with the United States Video Privacy Protection Act and seeks payment of potential statutory remedies in the event that a breach is found to have occurred.

The Company currently is assessing the validity of claims as part of the aforementioned litigation. The number of putative plaintiffs who will participate in the case (Class Members), and therefore the total amount of the asserted claims are not yet known.
